1. Acceptance of Terms

By accessing or using Nursing Careers Australia ("the Platform"), operated by Martin Digital Group, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform. These terms apply to all users, including job seekers, employers, and visitors.

2. About the Platform

Nursing Careers Australia is an online job board connecting nursing professionals with employment opportunities across Australia. The Platform provides job listing, application, and lifestyle enrichment services. We are not an employment agency, recruiter, or employer. We do not guarantee employment outcomes or the accuracy of information provided by employers or job seekers.

3. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate and current information during registration.

We reserve the right to suspend or terminate accounts that violate these terms, provide false information, or engage in conduct that harms other users or the Platform.

4. Job Seekers

Job seekers may browse listings, create an account, save jobs, and submit applications through the Platform. By applying for a role, you consent to your application details (name, email, phone, cover letter, resume) being shared with the employer who posted the listing.

You are responsible for the accuracy of information in your profile and applications. Misrepresentation of qualifications, registration status, or working rights may result in account termination.

5. Employers

5.1 Job Listings

Employers may post job listings by creating an account, submitting listing details, and completing payment. All listings must relate to genuine nursing or healthcare employment opportunities in Australia. Listings must accurately represent the role, location, remuneration, and requirements.

Employers must not post listings that:

Are misleading, fraudulent, or deceptive. Discriminate unlawfully on the basis of age, gender, race, disability, religion, sexual orientation, or any other protected attribute under Australian law. Require upfront payment from job seekers. Promote multi-level marketing, commission-only schemes, or non-genuine employment. Contain offensive, defamatory, or inappropriate content.

We reserve the right to remove any listing that violates these terms, without refund.

5.2 Content Responsibility

Employers are solely responsible for the content of their job listings, including position descriptions, requirements, and remuneration details. We do not verify the accuracy of listing content. The Platform's AI formatting feature structures listing content for readability but does not alter the substance of what employers provide.

6. Payments and Refunds

6.1 Listing Fees

Job listings require payment before publication. Current pricing is displayed on our Pricing page. We offer two listing tiers: Standard and Featured. Prices are in Australian dollars and include GST where applicable.

6.2 Listing Duration

Each listing is published for 30 days from the date of payment, unless an earlier closing date is specified by the employer. Employers may extend listings for an additional 30 days by making a further payment.

6.3 Payment Methods

We accept payment via credit/debit card (processed immediately via Stripe) or invoice (14-day payment terms). All payment processing is handled by Stripe. We do not store your payment details.

6.4 Refunds

Refunds are available within 7 days of payment if the listing has not yet been published or has received no applications. Once a listing is live and has received applications, refunds are not available. If a listing is removed by us for breach of these terms, no refund will be issued. Refund requests should be directed to info@nursingcareers.com.au.

7. Lifestyle Enrichment Data

The Platform provides lifestyle enrichment data for job listings, including distances to beaches, airports, universities, national parks, and other amenities. This data is calculated automatically using geocoding and spatial databases. Distances are approximate, calculated as straight-line distances, and are provided as a guide only. We do not guarantee the accuracy, completeness, or currency of enrichment data. Users should independently verify lifestyle information before making relocation decisions.

8. Intellectual Property

The Platform's design, branding, code, and original content are the intellectual property of Martin Digital Group. Job listing content remains the property of the employer who posted it.

By posting a listing, employers grant us a non-exclusive licence to display, format, and distribute the listing content on the Platform and in search engine results for the duration of the listing.

9. Limitation of Liability

To the maximum extent permitted by law, Nursing Careers Australia and Martin Digital Group are not liable for:

Any loss, damage, or expense arising from the use of the Platform. The conduct, representations, or reliability of employers or job seekers. Employment decisions, outcomes, or disputes between employers and candidates. Technical failures, downtime, or data loss. Inaccuracies in lifestyle enrichment data or AI-generated content.

Nothing in these terms excludes or limits liability that cannot be excluded under Australian Consumer Law.

10. Indemnification

You agree to indemnify and hold harmless Nursing Careers Australia, Martin Digital Group, and their officers, employees, and agents from any claims, losses, or expenses (including legal fees) arising from your use of the Platform, your breach of these terms, or your violation of any law or the rights of a third party.

11. Modifications

We may modify these Terms of Service at any time. Material changes will be communicated to registered users via email. Continued use of the Platform after changes are posted constitutes acceptance of the revised terms. The "Last updated" date at the top of this page indicates when these terms were last revised.

12. Governing Law

These Terms of Service are governed by the laws of the State of Victoria, Australia. Any disputes arising under these terms are subject to the exclusive jurisdiction of the courts of Victoria.
